On Friday, Nov. 17, a Los Angeles judge dismissed a domestic violence restraining order against singer Tyrese Gibson filed by his ex-wife Norma Mitchell, according to NY Daily News. Judge Shelley Kaufman also restored the parents' original 50-50 shared custody agreement of their 10-year-old daughter Shayla that established in January.
NY Daily News reports that Kaufman found all allegations that Gibson emotionally and physically abused his daughter "100 percent unsubstantiated." Gibson reportedly covered his face and his sobs with tissue as the judge denied the stay-away order for which Mitchell filed claiming her ex-husband pushed her down a flight of stairs in 2004, struck her on two separate occasions in 2007 and hit her in the face in 2011.
Mitchell's originial restraining order request was filed in September after she claims Gibson hit their daughter so hard in August, the child "claimed she could not sit down due to the pain she was experiencing.” However, Kaufman said Mitchell's allegations failed to meet the burden of proof. Gibson has denied ever abusing his daughter.
During the court proceedings, Kaufman also addressed Gibson's recent social media posts regarding the custody battle with his ex-wife. The judge said while the posts were a little "melodramatic," Gibson's recent social media activity, including a video that named Mitchell twice, didn't violate the terms of the temporary restraining order.
“He is a public figure who communicates with the public, and I don't find this was a mechanism to communicate directly with the restrained parties,” she said.
According to NY Daily News, Gibson apologized for his erratic behavior on social media, stating that his recent behavior was caused by an adverse reaction to medication. And like clockwork, Gibson took to Instagram again to share the good news after the judge's ruling.
The "Transformers" star also couldn't seem to resist commenting on his ex-wife's courtroom behavior, which he deemed inappropriate.
After the rough custody battle over the pass few months, Gibson shared his experience as a father fighting for shared custody of his daughter. On Instagram, he asked other fathers to share their stories as well.
