Update (July 31, 2019): Assault charges against 10-year-old Bryce Lindley have sensibly been dropped.

Wayne County Prosecutor Kym Worthy decided against prosecuting the fourth grader for aggravated assault, according to WXYZ. The charge stemmed from injuries an unidentified boy sustained after Lindley allegedly threw a rubber ball at his head in April. The other child’s mother filed a police report.

“He sustained facial tissue damage to his face. He had a black eye and a bruised nose," the boy’s mother told KSFY.

The mother of the unidentified child alleged he has a condition that made the concussion he sustained from the game dangerous. Cameishi Lindley, Bryce’s mother, apologized for the injury but believed the school should have taken proper precautions.

Worthy announced her decision with a lengthy statement on Wednesday. She insisted race had nothing to do with this case. Worthy blamed the controversy surrounding this incident on “quite a bit of inaccurate reporting in this case.”

“The mother of the alleged victim had every right to go to the authorities and the authorities had an obligation to investigate,” she said. “When this case was reviewed by my office, no one paid attention the race of either party. It is categorically wrong to suggest that this was charged based on race or geography.”

Worthy also expressed hope the families would be able to find a solution together since “both families involved love their children and want the best for them.”

“While the charge in this case is certainly sustainable, I have instructed my staff to dismiss this case today,” Worthy concluded. “It is my earnest hope that both sides will come back to the table to work out a solution that benefits both of these children. Again, I am confident that both of them are highly valued. I want to make sure that both children are served as we move forward and hopefully these charges will not have to be revisited.”

Neither Lindley’s family nor the parents of the other child have spoken about the latest decision.

Original story: A Black Canton, Michigan, fourth grader was charged with aggravated assault after a student suffered a concussion in a schoolyard game. 

Bryce Lindley was only playing a game with his other classmates on April 29 at Ruth Eriksson Elementary. The dodgeball-like game required students to throw balls up into the air. An unnamed student reportedly suffered a concussion while playing the game, according to WXYZ. The unidentified student involved was allegedly hit in the face by one of the balls. A police report claimed Bryce purposely threw a ball at the student. However, Bryce's mother Cameishi Lindley isn't so sure.

"These kids are basically playing a game we all have played," Lindley told 7 Action News.

Yahoo News reports in late July, Lindley received a call from the juvenile court informing her that her son was being charged for the incident.

The injured student's mother has refused to release her name as well as her child's identity. However, she told the Michigan news outlet that her son experienced similar interactions before. Video from the news report suggests the parent may be white and/or of Caucasian descent. 

“He sustained facial tissue damage to his face. He had a black eye and a bruised nose," the parent told the outlet.

In previous incidents, the student was reportedly hit in the face twice and the child and Bryce remained friends. 

“My son was hit twice in the face with a ball previously due to this," she recalled. "The child apologized to my son and my son said 'mom it’s okay we’re still going to be friends.'"

Bryce's mother was not aware of the prior instances. She did apologize for the child getting hurt. 

“I am unaware of any of those situations," Lindley said. "I’m sorry that her child got hurt. I’d be sorry for any child that got hurt.”

In recent days, the 10-year-old's story has made national news. Social media users are crying foul, claiming the charges are racially motivated. 

Additionally, Lindley has set up a fundraiser to pay for the legal fees totaling $4,000. As of this report, an estimated $10,000 and counting has been raised within the last six days. Bryce is scheduled to appear in court this upcoming Thursday.  

"First, let me just say this," she wrote in a Facebook post. "You all are AMAZING!!!! Not only did Bryce’s legal defense fund reach its goal, it far exceeded it. For now, I’ve decided to leave the GoFundMe account up until the hearing is held on Thursday."
