Text messages between Amber Guyger and her partner are being used by the prosecution to prove whether or not the off-duty officer was as tired as she claimed she'd been when she shot Botham Jean. 

On the night of September 6, 2018, Guyger fatally shot the 26-year-old Harding University graduate in his home. She alleges she believed she'd entered her own apartment and thought Jean was an intruder. The Dallas ex-cop was eventually fired after the public pressured the city's police department. 

NBC News reports Guyger had a relationship with a fellow officer identified as Martin Rivera. On that night, the 31-year-old was reportedly on the phone with Rivera when she drove into the garage.

There were several messages sent between the two just moments before the 10 p.m. shooting. Lead prosecutor Jason Hermus also revealed the former officer sent a sexually suggestive Snapchat message to Rivera between that time as well. 

“When can I come over?” Rivera asked in his message.

“You can come over after this,” Guyger responded.

She then told her partner that she wanted to see him later, indicating she wanted more than conversation. She texted: “super horny today too,” and Rivera responded, “me too.”

Guyger reportedly ask him in her next text: “Do you wanna touch?”

The prosecution believes the text shows Guyger was distracted prior to the shooting. Her alleged fatigue was not the culprit leading to her entering Jean's apartment in mistake.

Instead, prosecutors argue Guyger's back-and-forth texts shows that she wasn't as tired as she claimed. Initially, the former officer claimed she was fatigued from working for over 13 hours. Due to the sexual nature of the texts, her fatigue is in question.
