A New York man will serve no jail time even though he admitted he raped a 14-year-old girl.

Shane Piche was sentenced to 10 years of probation for rape on April 25, according to The Watertown Daily Times. He is required to register as a level 1 sex offender. Piche is also responsible for $375 in court fees and a $1,000 sex offender registration fee.

Piche, a former Watertown City School District bus driver, met the girl on one of his routes, but the assault occurred at his home. He pleaded guilty to third-degree rape on February 21 to honor a plea agreement.

Piche was also charged with first-degree unlawfully dealing with a child and endangering the welfare of a child. The district attorney’s office originally recommended he be registered as a level 2 sex offender, but the request was denied. Under his current level, he isn’t allowed near anyone under the age of 17 with a few exceptions, but his address won't be published on public sex offender databases.

Judge James P. McClusky said Piche’s sentence was light because he had no prior criminal record, and there was only one victim involved. McClusky argued there was a “low risk of re-offense,” reports The Washington Post.

The victim’s mother condemned the decision in a statement, according to the New York Post.

“I wish Shane Piche would have received time in jail for the harm he caused to my child,” she said.

“He took something from my daughter she will never get back and has caused her to struggle with depression and anxiety.”

Eric T. Swartz, Piche’s lawyer, believes the punishment is appropriate.

“He’ll be a felon for the rest of his life. He’s on the sex offender registry for a long time,” Swartz said, according to WWNY. “Maybe not the rest of his life because of the level but this isn’t something that didn’t cause him pain and this isn’t something that didn’t have consequences.”
