Update (May 2, 2019): Samantha Smith’s urgent request for temporary custody of Emani Asghedom has been denied.
As Complex reports, the judge rejected the request made by the late rapper’s sister stating that the circumstances do not permit the need for immediate transfer of custody.
"No urgency demonstrated for granting this relief prior to hearing on May 14th," the ruling states in documents obtained by The Blast.
Smith, who filed the emergency order earlier this week, stated that she did not want to inform Tanisha Foster, the child’s mother, about her desire to gain custody.
The judge ruled that Foster must be made aware of the notice for custody before the hearing.
Foster and Nipsey reportedly shared joint custody of Emani due to a 2013 ruling. However, Smith documented in her petition for guardianship that Nipsey had been the 10-year-old’s primary custodian for years. She also noted in her request that her drive to continue as Emani’s guardian is to ensure the child will remain in a familiar and stable environment.

Yahoo reports Samantha Smith has filed a petition to become the official guardian of Emani Asghedom, one of Nipsey's two children. The 33-year-old businessman was reportedly the primary caretaker of his daughter, the eldest of his offspring, up until his death on March 31.
The young girl's mother, who goes by Tanisha Asghedom and Chynna Hussle online, has reportedly not attempted to file for custody of her daughter since her father's death.
According to TMZ, the forms were submitted "to ensure the continued stability for Emani and ensure that she will be able to maintain her current and ongoing relationship" with her paternal family. The legal papers purportedly assert that Samantha has played a role in Emani's life since birth, stating that she's helped raise her and would like to continue.
The hopeful guardian wrote that she's “always been a presence in Emani’s life and, along with the rest of Emani’s paternal family, has assisted in her care.”
Nipsey's father, Dawit Asghedom, also consented and confirmed that he believes Smith is fit for the parental role.
The Grammy-nominated artist's family expressed in the documents the desire for Emani to continue living with his paternal family with "whom she has always had close ties.”
Smith, whose age is unknown, spoke at the rapper's Staples Center memorial service about the impact her older brother had on her upbringing and the closeness they shared. She visibly comforted the young girl throughout the entirety of the ceremony and assisted her while she was on stage to give a speech, as Blavity reported.
Nipsey Hussle also had a younger son, Kross, with his long-time girlfriend, Lauren London.
