Two white men shot at a FedEx driver while he was delivering packages in a Brookhaven, Mississippi, neighborhood, CNN reports. On Jan. 24, close to 7 p.m., D'Monterrio Gibson, 24, said he had delivered a package to a residence when he noticed a white pickup truck pulling out from behind the house.

The truck approached the FedEx driver and started honking his horn, Gibson recalled.

Gibson's attorney, Carlos E. Moore, said Gibson was wearing the FedEx uniform but was driving in an unmarked FedEx vehicle. Gibson was driving a Hertz rental van with two large company stickers on the vehicle's rear.

Initially, Gibson thought his vehicle was preventing the truck from leaving, so he drove away. However, he says the white pickup truck attempted to cut him off.

"At that point, my instincts kick in, and I swerve around him as he (is) trying to cut me off to avoid getting stuck in the neighborhood," he told CNN.

Gibson said he drove down the street, passing two or three houses, when another man stood in the middle of the road and pointed a gun at Gibson's vehicle. The man mouthed instructions for Gibson to stop, but he said he refused and swerved around him.

The 24-year-old then heard "at least five shots and heard the bullets hitting the van," according to the incident report filed on Jan. 25. Gibson was not injured.

The white pickup truck continued to pursue him until he reached the interstate highway near Brookhaven and then retreated, CBS News reports.

"This man is fully, gainfully employed by FedEx, doing his job, and still you haul off and try to chase him and cut him off and shoot him multiple times and kill him. It's sickening to be that hateful and that racist and that full of just, malice, just because of the color of his skin," Moore said, WJTV reports.

Moore said the police are not showing urgency regarding the incident or the investigation. The two white men, 58-year-old Gregory Charles Case and his son, 35-year-old Brandon Case, were arrested and released on Feb. 1. Gregory is facing charges of conspiracy and Brandon was charged with aggravated assault, according to CBS News.

Attorney Moore wants the state to upgrade the charges to attempted murder and is requesting the incident be investigated as a federal hate crime.

"He was simply Black while working," Moore said of Gibson at a news conference.

Despite the incident, Gibson said that his supervisors told him to return to the same route.

"The following day, we had to go file a police report, and as soon as I was done filing a police report, they put me back on the same route. I did that for like a day or two until I started having real bad anxiety attacks, and I just couldn't do it anymore. I asked them for some time off, which I do have, but it's unpaid," Gibson said, according to WJTV.

FedEx issued a statement about the altercation, saying, "FedEx takes situations of this nature very seriously, and we are shocked by this criminal act against our team member."

"The safety of our team members is our top priority, and we remain focused on his wellbeing. We will continue to support Mr. Gibson as we cooperate with investigating authorities," the statement continued, according to WJTV. 

Moore compared Gibson's experience to Ahmaud Arbery, who was killed by two white men while jogging in a Georgia neighborhood in 2020.

James A. Bryant II, Gibson's other attorney, said on Thursday that his client is experiencing pain and trauma because two men tried to kill him due to the color of his skin.

"That has to be the most frightening experience one could face as a young Black man," Bryant said, according to CBS News. "And then not only that — they continued to chase him until they got to the freeway. So what would have happened if they were able to cut him off?"
