The ex-Baton Rouge police officer who killed Alton Sterling was seen hitting someone who was in handcuffs a month prior to the fatal July 2016 shooting, reports the Associated Press

Recently released body cam footage shows Blane Salamoni slapping a handcuffed man during an arrest in June 2016. According to the AP, the video was released Monday by the Baton Rouge Police Department.

The department issued a court summons to the former officer for a misdemeanor charge of simple battery. A conviction for simple battery is punishable by up to six months in jail and a $1,000 fine, according to The New York Post.

A month after the incident, Salamoni and officer Howie Lake II confronted Sterling outside of a Triple S Food Mart convenience store. 

Salamoni and Lake were responding to a 911 call claiming that Sterling drew a 9mm handgun on a man in the area. At the time, Sterling was selling bootleg CDs at the store, as he always did according to locals. It has yet to be proven if Sterling did draw the gun; however, newly released footage from March shows the moment officers encountered Sterling. 

“Don’t f**king move or I’ll shoot you in your f**king head,” Salamoni could be heard yelling to Sterling as he held a gun to his head. After a scuffle ensued, the former officer shot Sterling six times. 

Both officers were reprimanded for the shooting. Salamoni was fired, and Lake was suspended for the shooting of the 37-year-old father of five.

Police chief Murphy Paul's decision to punish the duo came days after Louisiana Attorney General Jeff Landry announced that they would not be charged for Sterling's death in late March. 

“Blane just wants to clear his name,” Salamoni’s lawyer, Brant Mayer, said after the latest video surfaced. “This is just one more thing Blane has to deal with before he puts this chapter behind him.”

Mayer said that the police department knew about the video and is allegedly using the video of the slapping to taint Salamoni's appeal. 

“There were no issues at that point,” he added.
