Last November Florida passed Amendment 4, which restores voting rights of Floridians with felony convictions after they complete the terms of their sentence. Despite objections from voting-rights advocates, a Florida House Subcommittee approved a bill Tuesday, 10-5, which adds restrictions to Amendment 4.

The bill requires ex-felons to pay all court fees and costs to be eligible to vote. The bill also requires departments of State and Corrections to share information on felony history and eligibility, a requirement the Orlando Sentinel notes did not exist before.

"Previously, there was no one database shared by the departments of State or Corrections, and the DOC would only investigate a felon’s history after [they] applied for clemency," the publication wrote.

Kirk Bailey, political director for the American Civil Liberties Union of Florida, said Tuesday's bill was expected. Bailey said it would stop individuals from voting based on the size of their bank account.

“This is exactly what we were worried about from the beginning,” Bailey said. “Legislative attempts to undermine the will of the people who voted for second chances, and to rid Florida of the last vestiges of its Jim Crow era past.”

Additionally, the bill re-defines a felony sexual offense, an exception along with murder, for which those with felonies would not have their voting rights restored. Sex workers convicted of prostitution three times, cyberstalkers, and inmates who exposed themselves to prison workers fall under that group according to WLRN

State Rep. James Grant (R), chairman of Florida’s House Criminal Justice Subcommittee, told the Orlando Sentinel the constitutional amendment was unclear.

“When the Constitution says ‘felony sex offenses’ that means nothing legally. The best I can do is propose a list of felonies that are sexual,” Grant said.

Defense Attorney, Rep. Michael Gottlieb (D-Davie) said the bill’s supporters were engaged in “efforts to purposefully misinterpret” the amendment’s language. Others likened the fee payment to a poll tax.
