Only a month after an Ohio daycare worker was filmed allegedly forcing toddlers to fight each other, we sadly have a similar incident to share.  

As KTVI reports, Nicole Merseal is suing St. Louis daycare Adventure Learning Center after video surfaced of toddlers engaging in a "fight club" at the school. Merseal's 10-year-old son filmed one of the fights on his iPad in 2016.

The disturbing video obtained by McClatchy and posted to The Kansas City Star shows a child pummeling another child, believed to be another of Merseal's sons while wearing foam Hulk costume fists. The brief video shows an adult — who appears to be a teacher — standing and watching instead of intervening.

Merseal said when she saw the video she called the police and filed a report.

The Missouri Department of Health and Senior Services investigated the facility and found “two separate children verified that fighting was allowed to take place." A former staff member told the department teachers allowed the fights to happen.

Merseal says the fights bothered her young son. "He doesn't understand why his friends were fighting him," the mom said. "Why he was beaten up by his best friends."

Daycare cameras captured 30 minutes of footage beyond what Merseal's son filmed. According to CBS News, both teachers who appeared in the video were fired. The St. Louis Circuit Attorney's Office did not prosecute the school, which is still fully operating. 

"There was insufficient evidence to prove beyond a reasonable doubt that any laws were violated. However, that does not diminish the incredibly poor judgment by these adults who had the responsibility to safely supervise these children," said the Attorney's Office in a statement.

However, Merseal believes more should be done and thinks the entire facility should be held accountable. According to ABC News, Merseal is suing the school for more than $25,000. 

"I want them to be held accountable, and I don't want this to happen to any other child," Merseal said.
