State District Judge Tammy Kemp has decided to delay the murder trial of former Dallas police officer Amber Guyger to September 23 after her lawyers filed a continuance motion.
Toby Shook, one of Guyger's attorneys, is the lead lawyer in a federal trial which will start on July 29. The original start date for Guyger’s trial was in August, but Shook claimed he would not have had enough time to prepare.
Guyger is facing a murder charge after killing Botham Jean, a well-liked accountant originally from St. Lucia, in his home on September 6. The case quickly gained international prominence.
Guyger lived in the same apartment complex as Jean and said she shot him after getting off on the wrong floor and mistaking his apartment for hers. According to her initial version of events, she tried to use her key fob on Jean’s door, and it did not work. He opened the door when he heard her trying to open it, and she shot him after he “failed to respond to her commands.”
She then changed her story to say that Jean’s door was open for some reason — something his family has repeatedly said makes no sense — and she thought he was a burglar. She shot him twice in the chest, killing him. Jean’s sister said right before his murder, he texted her about eating dinner and relaxing while watching football. The 26-year-old had a large red carpet in front of his door so that people would know it was his apartment, putting into question much of Guyger’s story.
Guyger was fired from the police force later that month after she was arrested on manslaughter charges. Due in no small part to national outrage over the murder, the Dallas County District Attorney's Office decided to change it and indict her on murder charges. Police have said that after reviewing the evidence, they do not believe her story and think she shot Jean on purpose.
Jean was buried in St. Lucia in September.
