A Tennessee man, who’s upset with Popeyes after never trying their new spicy chicken sandwich, is taking his frustrations to court.
According to WTVC, Craig Barr of East Ridge, Tennessee, filed suit on Wednesday against the fast-food chain for "false advertising, deceptive business practices by entity to public.”
“Countless time wasted driving to and from Popeyes. No chicken sandwich. Was told to come back this day- still no sandwich,” the suit continued.
Earlier this week, the franchise announced they’ve temporarily pulled the item after selling out the limited-edition product nationwide. The company’s two-month supply of chicken sandwiches ran out in just a little over two weeks of its release following a social media craze.
As several fans used humor to cope, Popeyes even joined the conversation by writing to a frustrated customer that "It's not what we wanted…but greatness comes with a price."
The brand’s battle of the poultry with Chick-fil-A was among the contributors to the phenomenon, which resulted in long lines across the country.
Barr, who works in the automobile industry, also claims he got "scammed" after he paid $25 in response to a Craigslist ad with an employee claiming to have a sandwich stashed away. However, when he showed up to the restaurant to get it, Barr said the employee took his cash and vanished.
"I can't get happy; I have this sandwich on my mind. I can't think straight…it just consumes you,” Barr told The Times Free Press.
"It's totally deceptive. Who runs out of chicken? It's a big fiasco. Someone has to stand up…everyone is captivated by these sandwiches. They've got everyone gassed up on them," he continued.
Barr is expected to face a local judge in court for the case in October.
