As 31-year-old Lyndo Jones continues to deal will complications of a Nov. 8 police-involved shooting in Mesquite, Texas, Police Officer Derick Wiley will face a grand jury on Nov. 28 to determine criminal charges for the shooting of the unarmed victim.
Earlier this month, police were called for a possible car break in. When they arrived on scene, they encountered Arlington man, Lyndo Jones, who was trying to get into his vehicle moments before. According to The Dallas News and Police Lt. Brian Parrish, Jones ran from officers and was shot during a struggle with one police officer.
After the brief struggle, back up arrived and those additional three officers handcuffed Jones. But this recount of the events on that Nov. 8 evening is not the same as Jones' and his attorneys, Lee Merritt and Justin Moore.
Merritt and Moore stated that their client had accidentally set off his truck's alarm and was attempting to disarm it when an unidentified person offered to assist him. Jones turned down the assistance and that person called 911 believing it was a break in.
The officers approached and told Jones to vacate the vehicle. Wiley reportedly shot Jones in the abdomen area twice while he tried to explain the situation despite the fact that Jones was unarmed and compliant. The statement also alleges that the police attacked Jones when they were trying to perform an "anal cavity search."
"Mr. Jones reacted to the unlawful sodomy and was consequently shot a second time in the back," the attorneys' written statement reads.

Jones had to be transported to a local hospital for his wounds. In fact, the victim was readmitted to the hospital around 4:21 a.m. Saturday, Nov. 25 because of lingering complications from the shooting, per The Root.
Initially, Jones was charged with evading arrest but District Attorney Faith Johnson dropped the misdemeanor charge after the Dallas County District Attorney’s Office reviewed Wiley’s body cam footage of the shooting.

The victim was handcuffed to a hospital bed prior to officially being released from police custody on Nov. 15. Think Progress reported that Jones was barred from seeing his children during the time of his custody/hospital stay.
“We’ve seen this preemptive, transparent vilification of innocent people play out time and time again,” Merritt told The Root. “Lyndo Jones is a hard-working father of two young daughters who was profiled by a stranger and shot by Officer Wiley for no reason at all. Wiley is the violent perpetrator here, not my client.”
The veteran officer was placed on paid administrative leave while the Dallas County District Attorney’s Office and the Mesquite Police Department are conducting two separate investigations.
Even though Wiley will face a grand jury, it is quite possible that he won't be charged with the unlawful shooting.
“Only 1 percent of law-enforcement misconduct is prosecuted in the state of Texas," Merritt told The Root. "That is by design.”
