A conservative legal group has filed a civil rights complaint against Texas Roadhouse, accusing the restaurant chain of practicing illegal discrimination through diversity, equity and inclusion (DEI) practices.

The New York Post reported that America First Legal filed the complaint with the Equal Employment Opportunity Commission, alleging that Texas Roadhouse violated the Civil Rights Act of 1964 through its hiring practices. 

AFL claims the company considers race, gender and ethnicity in board of directors selections, tracks employees’ demographic data, and implements DEI-focused policies that pose a “reputational risk” to the business.

“The evidence demonstrates that the Company’s hiring, promotion, and recruitment practices violate state and federal law. The evidence also demonstrates that the Company has prioritized unlawful diversity, equity, and inclusion programs and policies over shareholder value,” the complaint states, according to the New York Post. 

What does the complaint allege?

The complaint alleges that Texas Roadhouse acted with an “inappropriate disregard of your fiduciary duties to Texas Roadhouse and its shareholders,” claiming its DEI policies conflict with the groups’ interests.

AFL further criticized Texas Roadhouse for promoting DEI programs, including its Women’s Leadership Summit and African American Leadership Summit, and for aligning with environmental, social and governance goals that include diversity targets.

In response, Texas Roadhouse defended its commitment, stating that the company is “attracting, retaining, engaging, recognizing, and developing a workforce that mirrors the diversity of our guests,” according to the New York Post. The restaurant also shared a chart from its 2024 10-K annual report that illustrates the representation of women and people of color in its workforce and leadership.

Additionally, Texas Roadhouse confirmed that it considers DEI practices such as gender and race, along with board experience and financial acumen, when selecting individuals to fill the board of directors roles.

Blavity reported that President Donald Trump signed a series of executive orders in January, including one that targeted DEI initiatives in the federal government and private company sectors. Since then, several well-known companies have backtracked on their commitment to fostering diverse work environments.
